ATTENTION: CONTRACTORS
The City of Leominster has adopted a new city ordinance
regarding Cash Security. As of August 14, 2001 contractors are
no longer required to furnish a $2,000 Performance Bond but are
required to comply with the provisions of Section 20-18 Cash
Security of the Leominster City Ordinances.
Enclosed is a copy of this new ordinance for your convenience.
The W9 form must be completed and delivered to the Department of
Public Works with a check for $5,000.00 before any work can
begin and/or continue within the City as of August 14, 2001.
For your convenience a copy of insurance guidelines is enclosed
so that you can properly continue with the required insurance
requirements.

Section 20-18 Cash Security.
No person shall install any utility or other private connection
into any public utility including water and sewer connections
and/or renewals, drainage, drilling and all other types of
excavation unless such person has delivered to the city a cash
security in the sum of five thousand dollars for the faithful
performance of such work he may execute, and to make good any
defects in material or workmanship which may appear in the
utility trench on account of work done by said insured
contractor, and to remunerate the city and any person connected
to such work for loss or damage occurring in consequences of any
act done under any permit granted such contractor. The five
thousand dollar cash security will be held for the two (2) year
guarantee period. Two (2) years after the completion of the last
permit work, a permittee can request the Department of Public
Works for release of the security. If all permit obligations
have been met, the security will be returned in its entirety
with interest.
21-13 (b) Regulations for Use of Water
Service pipes shall be of such sizes and materials as the
Director shall determine. All work shall be done by an insured
and cash security contractor approved by the Department. All
expense of laying such pipe from the main line to and through
the cellar wall or to other place desired, together with the
cost of the same and of the stopcock and valve shall be paid by
the applicant and inspected and approved by the Department. The
entire cost of any service of a seasonal or temporary nature
such as a construction trailer shall be paid by the applicant.
The service pipe and any valve to the premises served shall be
installed and maintained by the customer at his expense and
shall be owned by the customer. The customer shall be
responsible for his service pipe and the Department will not
perform repairs and new installations on private property. |
INSURANCE REQUIREMENTS
In order for a contractor to do work in the City of Leominster,
he must first submit a $5,000 cash security as required in
Section 20-18 of the Leominster City Ordinances, the proper
insurance forms, and 3 letters of reference. The following
revised guidelines must be met:
Indemnification: The Contractor agrees to indemnify, pay on
behalf of, defend and hold harmless the City from and against
any and all claims, demands, suits, actions, costs, judgments,
whatsoever, including reasonable attorney’s fees, which may be
imposed upon, incurred by, or asserted against the City by
reason of (a) any failure on the part of the Contractor to
comply with any provision or term required to be performed or
complied with by the Contractor under this Agreement, or (b) for
the death, injury or property damage suffered by any person on
account of or based upon the act, omission, fault, negligence or
misconduct of any person whomsoever other than the City.
The foregoing indemnity and hold harmless agreement shall
include indemnity against all costs, expenses and liabilities
incurred in or in connection with any such claim or proceeding
brought hereon, and the defense thereof with counsel acceptable
to the City or counsel selected by an insurance company which
has accepted liability for any such claim.
Insurance: The Contractor agrees to maintain in full force from
the Commencement Date until the expiration of the term of this
Agreement, and thereafter so long as the Contractor is in
occupancy on the Premises, a policy of leading comprehensive
public and commercial general liability and property damage
insurance under which the Contractor is named as insured and the
City is named as additional insured, and under which the insurer
agrees to provide coverage in the minimum amounts set forth
below. Each such policy shall be non-cancelable and
non-amendable with respect to the City without thirty (30) days
prior notice to the City and a duplicatie original or
certificate thereof shall be delivered to the City within (5)
days of a request therefore.
The minimum limits of General Liability of such insurance shall
be not less than One Million Dollars ($1,000,000) per
occurrence/combined single limit and shall be not less than Two
Million Dollars ($2,000,000) in the aggregate per permit site.
All required insurance shall be written with such companies
qualified to do business in Massachusetts. In addition,
insurance coverage for Bodily Injury and Coverage for Collapse
and Underground Structures will not be less than One Million
Dollars ($1,000,000).
Safety: The Contractor shall be responsible for providing
adequate safety measures for all persons and all property upon
the permit site. |
