ARTICLE I. Sec. 9-1. Definitions.
For the purposes of this chapter, the following words and phrases shall have the meanings respectively ascribed to them by this section:
Bulky waste. Rubbish which because of size or weight causes unreasonable difficulties in the operation of a normal solid waste disposal area such as building demolition material in excess of eight feet in length, car or truck bodies, and large tree stumps.
Garbage. All waste animal, fish, fowl, fruit or vegetable matter produced from or resulting from the preparation, use or storage of food for human consumption.
Hazardous waste. Those wastes which may be determined to be detrimental to the environment, such as, but not limited to, waste oils, solvents and chlorinated oils, toxic metals, etchants, pickling and plating wastes, explosives, reactive metals and compounds.
Permitted wastes. All refuse, except hazardous and bulky wastes.
Refuse. All combustible and noncombustible solid wastes including garbage and rubbish.
Restricted wastes. Hazardous and bulky wastes and that refuse, which because of its physical characteristics causes undo hardship of the solid waste disposal area.
Rubbish. All solid waste, combustible or noncombustible, other than garbage and dead animals, considered to be rejected and worthless matter, whether domestic or commercial.

ARTICLE II. Sec. 9-2. Supervision and maintenance.
Supervision of the dumping and disposal of refuse at the city solid waste disposal area shall be under the department of public works, and all rubbish shall be deposited under the direction of the man or men in charge.

Sec. 9-3. Liability.
All persons who dump, throw or drop any material of any nature or description at the city solid waste disposal area shall do so at their own risk.

Sec. 9-4. Disposal of wastes Generally.
All permitted waste shall be disposed of at the solid waste disposal area as designated by the department of public works and in accordance with this article and the Commonwealth of Massachusetts regulations for the disposal of solid wastes by solid waste disposal area. Only permitted waste as defined in section 9-1 generated from within the city may be disposed of at the city solid waste disposal area unless mutually agreed by city and contractor.

Sec. 9-5. Restrictions.
Hazardous waste shall not be disposed of at the solid waste disposal area or at any site within the city limits unless approved of by vote of the mayor, city council and the board of health. Other waste which, because of their physical characteristics, cause undo hardship to the operation or operators of the landfill will be prohibited.

Sec. 9-6. Salvaging.
Salvaging, by the city and contractor only, will be permitted in accordance to contract terms.

Sec. 9-7. Designated area to be used.
No person shall deposit or leave waste upon any of the approaches of the solid waste disposal area except that designated by the person in charge thereof.

Sec. 9-8. Hours of operation.
Regular dumping hours shall be determined by the city council.

Sec. 9-9. Vehicle solid waste disposal area permits Rate schedule for use of solid waste disposal area.
(a) Each city resident shall obtain a vehicle solid waste disposal area permit from the office of the treasurer for the purpose of disposing of rubbish at the city solid waste disposal area. A sticker for such permit will be issued which shall be affixed and clearly visible on the vehicle. The annual fee for such permit shall be as follows:
(1) Privately owned passenger vehicles, station wagons, pick-up trucks, vans and utility trailers No charge.
(2) All other vehicles $20.00.
(b) All vehicles entering the solid waste disposal area will be weighed unless specifically designated and charged as follows:
(1) Private passenger vehicles, including station wagons No charge.
(2) Privately owned pick-up trucks and vans entering with less than one hundred fifty pounds of solid waste per week No charge.
(3) Utility trailers with a gross weight of one thousand pounds or less No charge.
(4) All other vehicles The amount specified for commercial waste disposal in the city's solid waste disposal contract, as the same may be periodically adjusted.
The amount charged shall be adjusted annually in accordance with Consumer Price Index adjustment set forth in the solid waste disposal contract.

Sec. 9-10. Nonresidents.
Nonresidents will not be allowed to use solid waste disposal area except by mutual agreement between city and contractor and the company holding the contract to collect garbage and refuse.

Sec. 9-11. Suspension of permits.
Any permit may be revoked by the director of the public works department, upon receipt of evidence satisfactory to the director that the licensee has not conformed with the requirements of these regulations or such further regulations as may be adopted as to the collection and disposal of waste. A letter of warning shall be sent to the permit holder before suspension of a permit with copies to the mayor, the board of health and the city council.

Sec. 9-12. Truck covers required.
Trucks without proper covers will not be allowed to enter the solid waste disposal area.
