Sec. 11-1. License– Required; revocation and term.

The city council may license suitable persons to be collectors of, dealers in or keepers of shops for the purchase, sale or barter of junk, old metals or secondhand articles pursuant to the provisions of chapter 140 of the General Laws. All such licenses may be revoked at pleasure and shall expire on April thirtieth of each year.

Sec. 11-2. Same– Certificate from inspector of weights and measures required.

No person shall be licensed or assigned a badge or number under the provisions of this chapter until he presents a certificate from the inspector of weights and measures stating that all weighing and measuring devices intended to be used by such person have been duly inspected and sealed as required by law.

Sec. 11-3. Same– To designate place.

No dealer in junk, old metals or secondhand articles shall carry on his business in any other place than that designated in his license, unless a consent to his removal be granted by the council.

Sec. 11-4. Same– Required for collection vehicles.

No wagon or other vehicle shall be used for the collection of junk, old metals, rags or secondhand articles unless licensed by the council. Every such wagon shall bear conspicuously the owner's name and the number of the license on each side. Every license shall designate the person employed to drive such vehicle. Such driver shall not be changed without the consent of the chief of police.

Sec. 11-5. Same– Fees.

Any person receiving a license under this chapter shall pay a fee to the city clerk as follows:

Junk shop license . . . . $100.00.

Junk collector's license . . . . 50.00.

Junk dealer's license . . . . 100.00.

In all cases where more than one vehicle is used, the fee shall be one additional dollar for each additional vehicle.

Sec. 11-6. Issuance and display of number and badge.

All licenses granted under the provisions of this chapter shall be numbered, and the holder of any such license, while engaged in the business of collecting junk, old metals or secondhand articles, shall wear in plain sight upon his hat a badge with the number of his license thereon. Such badge shall be furnished to such dealer by the chief of police, and the sum of one dollar, which shall be returned upon surrender of the badge, shall be charged for the same.

Sec. 11-7. Sign to be displayed; examination of shop and merchandise; hours of business.

Every keeper of a junk or secondhand shop shall put in a suitable and conspicuous place on his shop a sign having his name and occupation legibly inscribed thereon in large letters. Such shop, all articles of merchandise therein and any place, vehicle or receptacle used for the collection or keeping of such articles may be examined at all times by the mayor and council, by any police officer of the city or by any person authorized by the mayor or council to make such examination. Every such shop shall be closed except from 7:00 A.M. to 9:00 P.M. on each week day, and no keeper thereof and no junk collector shall purchase or sell any articles during such hours.

Sec. 11-8. Records– Purchases; inspection.

Every keeper of a shop for the purchase, sale or barter of junk, old metals or secondhand articles shall keep a book in which shall be written at the time of every purchase of any such articles a description thereof, the name, age and residence of the person from whom and the day and hour when such purchase was made. Such books shall at all times be open to the inspection of the mayor and the council, any police officer or any person authorized by the mayor or council to make such inspection.

Sec. 11-9. Same– Sales.

When any junk, old metals or secondhand articles shall be sold by a dealer within one week from the time of purchase or receipt of the same, such dealer shall enter in his book the name and address of the purchaser with such other facts as may be necessary to keep track of the goods.

Sec. 11-10. Purchase from minors prohibited.

No dealer in junk, old metals or secondhand articles shall directly or indirectly purchase or receive by way of barter or exchange such goods or allow such goods to be deposited upon or within his premises, shop or vehicle by any minor, knowing or having reason to believe him to be such.

Sec. 11-11. Storage regulations.

No junk, old metals or secondhand articles shall be stored in any yard nearer than four feet to any building, and a clear space of four feet shall be left between any junk, old metal or secondhand articles so stored and the rear or side line of the lot, unless such lines are the line of a street or passageway at least four feet wide. All combustible material shall be kept under cover between sunset and sunrise.
