ARTICLE I.
IN GENERAL.

Sec. 13-1. Definitions.

For the purposes of this chapter, the following words and phrases shall have the meanings respectively ascribed to them by this section:

Bus stop. An area in the roadway set aside for the boarding of or alighting from the parking of buses.

Crosswalk. That portion of a roadway ordinarily included within the prolongation or connection of curb lines and property lines at intersections or that portion of a roadway clearly indicated for pedestrian crossings by lines on the road surface or by other markings or signs.

Emergency vehicle. Vehicles of the fire department, (fire patrol), police vehicles, ambulances and emergency vehicles of federal, state and municipal departments or public service corporations when the latter are responding to an emergency in relation to the police or fire departments.

Funeral. Any procession of mourners properly identified as such accompanying the remains of a human body.

Lane. A longitudinal division of a roadway into a strip of sufficient width to accommodate the passage of a single line of vehicles.

Official curb parking. That portion of a curbing, the painting of which has been authorized by the city council and which has written approval of the state department of public works.

Official street marking. Any painted line, legend, marking or marker of any description painted or placed upon any way which purports to direct or regulate traffic and which has been authorized by the city council and which has the written approval of the state department of public works.

Official traffic sign. All signs, markings and devices other than signals which are not inconsistent with this chapter, which conform to the standards prescribed by the state department of public works and which are placed or erected by authority of a public body or official having jurisdiction, for the purpose of guiding, directing, warning or regulating traffic.

Official traffic signal. All signals conforming to the standards as prescribed by the state department of public works and consistent with this chapter which are placed or erected by authority of a public body or official having jurisdiction, for the purpose of directing or warning traffic.

Officer. Any police officer, any investigator, examiner or inspector of the registry of motor vehicles and any constable or special officer; provided, that he has his badge of office displayed over his left breast and upon his outer garment.

Parking. The standing of a vehicle, whether occupied or not, otherwise than temporarily for the purpose of and while actually engaged in loading or unloading, or in obedience to an officer or traffic signs or signals or while making emergency repairs or, if disabled, while arrangements are being made to move such vehicle.

Parking meter. Any mechanical device, not inconsistent with the provisions of this chapter, which is placed or erected on any public way within the city for the regulation of parking. Each parking meter installed shall indicate by proper legend the legal parking time established by this chapter. When operated, it shall at all times indicate the balance of legal parking time permitted and at the expiration of such period shall indicate illegal or overtime parking.

Parking meter space. Any space within a parking meter zone adjacent to a parking meter which is duly designated for the parking of vehicles by lines painted on the surface of the street adjacent to or adjoining each parking meter.

Parking meter zone. Any street or portion thereof upon which parking meters are installed and in operation and upon which parking of vehicles is permitted for a limited time subject to compliance with the further provisions of this chapter.

Pedestrian. Any person afoot or riding on a conveyance moved by human power, except bicycles or tricycles.

Roadway. That portion of a street or highway between the regularly established curb lines or that part, exclusive of shoulders, improved and intended to be used for vehicular traffic.

Safety zone. Any area or space set aside within a roadway for the exclusive use of pedestrians which has been indicated by signs, lines or markings and which has the written approval of the state department of public works.

Service zone. An area in the roadway set aside for the accommodation of commercial and transient vehicular traffic.

Sidewalk. That portion of a street or highway set aside for pedestrian travel.

Street or highway. The entire width between property lines of every way open to the use of the public for purposes of travel.

Taxicab stand. An area in the roadway in which certain taxicabs are required to park while waiting to be engaged.

Traffic. Pedestrians, ridden or herded animals, vehicles, street cars or other conveyances either single or together while using any street or highway for the purpose of travel.

Traffic control area. Any area along any way, other than an intersecting way, at which drivers are to be controlled by traffic control signs.

Traffic control signal. Any device using colored lights which conforms to the standards prescribed by the state department of public works, whether manually, electrically or mechanically operated, by which traffic may be alternately directed to stop and to proceed.

Traffic island. Any area or space set aside within a roadway which is not intended for use by vehicular traffic.

U-turn. The turning of a vehicle by means of a continuous left turn whereby the direction of such vehicle is reversed.

Vehicle. Every device in, upon or by which any person or property is or may be transported or drawn upon a street or highway, except devices moved by human power or used exclusively upon stationary rails or tracts.

Vehicle, commercial. Any vehicle being used in the transportation of goods, wares or any merchandise for commercial purposes.

Vehicle, heavy commercial. Any commercial vehicle of two and one-half tons capacity or over.

Sec. 13-2. Direction of traffic.

It shall be the duty of the officer designated by the chief of police to enforce the provisions of this chapter. Officers of the police department are hereby authorized to direct all traffic either in person or by visible or audible signals in conformance with the provisions of this chapter; provided, that in the event of a fire or other emergency to expedite traffic or safeguard pedestrians, officers of the police or fire departments may direct traffic as conditions may require, notwithstanding the provisions of this chapter.

Sec. 13-3. Temporary closing of streets.

The chief of police is hereby authorized to close temporarily any street or highway in an impending or existing emergency or for any lawful assemblage, demonstration or procession; provided, that there is reasonable justification for the closing of such street.

Sec. 13-3.1. Temporary closing of bridges.

The city council is hereby authorized to close temporarily any city owned bridge in an impending or existing emergency; provided that there is reasonable justification for the closing of such bridge.

Sec. 13-4. Temporary prohibition of parking.

The chief of police is hereby authorized to temporarily prohibit parking on any street or highway or part thereof in an impending or existing emergency or for lawful assemblage, demonstration or procession; provided, there is reasonable justification for such prohibition. Vehicles parked in places where parking is prohibited temporarily may be moved by or under the direction of an officer.

Sec. 13-5. Experimental regulations.

For purposes of trial, the city council may make temporary rules regulating traffic or may test under actual conditions any traffic signs, signals, markings or other devices. No such experimental rule regulating traffic shall remain in effect for a period of time longer than thirty days.

Sec. 13-6. Zones of quiet.

All the territory within two hundred feet of the premises of each hospital in the city is hereby created and established as a zone of quiet. The chief of police is hereby authorized to erect and maintain in a conspicuous manner within this area such signs and markings as are necessary to designate it as a zone of quiet.

The chief of police may temporarily establish a zone of quiet upon any street where a person is seriously ill if requested to do so by the written statement of at least one registered physician certifying to its necessity. Such temporary zone of quiet shall embrace all territory within a radius of two hundred feet of the building occupied by the person named in the request of such physician and shall be designated by the police by placing at a conspicuous place in the street a sign or marker bearing the words "zone of quiet serious illness."

No person operating a motor vehicle within any designated and signed zone of quiet shall sound the horn or other warning device of such vehicle except in an emergency.

Sec. 13-7. One-way streets.

Upon the following streets and parts of streets, vehicular traffic shall move only in the direction indicated below:

Central Place, from Eden Glen to Central Street, in a westerly direction only.

Colburn Court, from Church Street in an easterly direction only.

Columbia Street, from Main Street to Depot Square in an easterly direction only.

Craven Drive, from the intersection of Norwood Avenue to Eleitin Avenue in an easterly direction only.

Cross Street, from Central Street to Lancaster Street in a northeasterly direction only.

Hamilton Street Connector, to River Street in a southerly direction only.

Haynes Court, from West Street to Monroe Street in a southerly direction only.

Howe Street, from Mt. Pleasant Avenue to Short Street in a southerly direction.

Main Street, from Wilderwood Avenue to the Lunenburg town line in a northerly direction only.

Mechanic Street cut-off, in a southerly direction only.

Merriam Avenue, from Columbia Street to Main Street in a westerly direction only.

Mt. Pleasant Avenue, from Howe Street to Pine Street in a southerly direction only.

Park Avenue, from Electric Avenue to Main Street in an easterly direction only.

Pine Grove Avenue, from Cushing Avenue to Main Street in an easterly direction only.

Prospect Avenue, from Electric Avenue to Main Street in an easterly direction only.

River Street, from the intersection of Hamilton Street and Crawford Street to Main Street in a southeasterly direction only.

River Street, from Hamilton Street in an easterly direction only.

Southerly driveway serving the Twin Cities Plaza, from Merriam Avenue into the plaza in an easterly direction only.

Stuart Avenue, from the intersection of Norwood Avenue to Electric Avenue in an easterly direction only.

Wilder Avenue, from Central Street in an easterly direction only.

Sec. 13-8. Location of bus stops, taxicab stands and service zones.

The location of all bus stops, taxicab stands and service zones shall be specified by the city council. In the case of taxicab stands, the city council shall designate who may use them as such.

Sec. 13-9. Streets reserved for coasting.

On those streets designated by the superintendent of streets and sewers department for coasting, vehicular traffic shall proceed cautiously and at no time at a speed exceeding ten miles per hour.

Sec. 13-10. Pedestrians soliciting rides prohibited.

It shall be unlawful for any person to stand in a roadway for the purpose of soliciting a ride from the operator of any motor vehicle.

Sec. 13-11. Clinging to moving vehicles prohibited.

It shall be unlawful for any person traveling upon any bicycle, coaster, sled, roller skates or any toy vehicle to cling to or attach himself or such conveyance to any other moving vehicle or street car upon any roadway.

Sec. 13-12. Prohibited riding.

No person shall ride on any street car, train or bus upon any portion thereof not designed or intended for the use of passengers; provided, that this section shall not apply to any employees engaged in the necessary discharge of a duty.

Sec. 13-13. Drivers to report accidents.

Every person operating a motor vehicle which is in any manner involved in an accident in which any person is killed or injured or, in which there is damage in excess of one thousand dollars to any one vehicle or other property, shall report such accident within five days to the registrar and to the police department in accordance with the provisions of chapter 90, section 26, of the General Laws.

Sec. 13-14. Traffic accidents and safety reports.

(a) The chief of police shall make an annual report concerning the accident situation in the city, accompanied by his recommendations.

(b) The police shall keep a record of all operators involved in personal injury accidents within the municipality.

(c) The police shall submit an annual traffic safety report containing the following:

(1) Pertinent data on safety activities accompanied by his recommendations.

(2) The plans and recommendations for future traffic safety activities.

Sec. 13-15. Exemptions from chapter.

The provisions of this chapter shall not apply to operators actually engaged in work upon a street or highway closed to travel or under construction or repair, to officers when engaged in the performance of public duties or to drivers of emergency vehicles while operating in an emergency and in performance of public duties when the nature of the work of any of these necessitates a departure from any part of this chapter. These exemptions shall not, however, protect the driver of any vehicle from the consequences of a reckless disregard of the safety of others.

Sec. 13-16. Owner of vehicle to be held responsible for violations.

If any vehicle is found upon any street or highway in violation of any provisions of this chapter and the identity of the driver cannot be determined, the owner or the person in whose name such vehicle is registered shall be held prima facie responsible for such violations.

Sec. 13-17. Penalty.

Except as otherwise provided in this chapter, by statute, or by any commission, department or other body authorized by law to impose penalties for violations of rules, regulations and orders governing the use and operation of vehicles, any person convicted of violating any of the provisions of this chapter or any temporary or experimental rule or regulation made under authority of Section 13-5 thereof shall be punished by a fine not exceeding thirty-five dollars.

ARTICLE II.
TRAFFIC CONTROL DEVICES.

Sec. 13-18. Responsibility for installation and maintenance; standards.

The police department is hereby authorized and it shall be its duty to place and maintain or cause to be placed and maintained all official traffic signs, signals, markings and safety zones required by this chapter. All signs, signals, markings and safety zones shall conform to the standards as prescribed by the state department of public works.

Sec. 13-19. When enforcement of chapter requires installation.

Sections 13-3, 13-4, 13-9, 13-34 to 13-52 inclusive, 13-88 and 13-89 shall be effective only during such time as a sufficient number of official signs are erected and maintained in each block designating the provisions of such sections and located so as to be easily visible to approaching drivers.

Sections relating to one-way streets shall be effective only during such time as a sufficient number of official signs are erected and maintained at each of the exits for each one-way street so that at least one sign will be clearly visible for a distance of at least seventy-five feet to the drivers approaching such an exit.

Sec. 13-20. Display of unauthorized signs, etc., prohibited.

It shall be unlawful for any person to place or maintain or to display upon or in view of any street any unofficial sign, signal, marking or device which purports to be or is an imitation of or resembles an official traffic sign, signal, marking or device or which attempts to direct the movement of traffic or which hides from view any official sign or signal. The chief of police is hereby empowered to remove every such prohibited sign, signal, marking or device or cause it to be removed without notice.

Sec. 13-21. Interference with signs, signals, etc., prohibited.

Any person who wilfully defaces, injures, moves, obstructs or interferes with any official traffic sign, signal or marking shall be liable to a penalty not exceeding fifty dollars for each and every offense.

Sec. 13-22. Obedience to traffic signs and signals.

No driver of any vehicle or street car shall disobey the instruction of any official traffic-control signal, sign, marking, marker or legend unless otherwise directed by a police officer. Any person convicted of a violation of this rule shall be punished by a fine of fifty dollars.

Sec. 13-23. Traffic-control signal legend.

Colors and arrow indications in traffic-control signals shall have the commands ascribed to them in this section and no other meanings, and every driver of a vehicle or other conveyance shall comply therewith, except when otherwise directed by an officer or by a lawful traffic regulating sign (other than a stop sign), signal or device or except as provided in section 13-85. In no case shall a driver enter or proceed through an intersection without due regard to the safety of other persons within the intersection regardless of what indications may be given by the traffic-control signals.

(a) Green. While the green lens is illuminated, drivers facing the signal may proceed through the intersection but shall yield the right-of-way to pedestrians and vehicles lawfully within a crosswalk or the intersection at the time such signal was exhibited. Drivers of vehicles making a right or left turn shall yield the right-of-way to pedestrians crossing with the flow of traffic.

(b) Right, left and vertical green arrows. When a right green arrow is illuminated, drivers facing such signal may turn right. When a left green arrow is illuminated, drivers facing such signal may turn left. When a vertical green arrow is illuminated, drivers facing such signal may go straight ahead. When a green arrow is exhibited together with a red or yellow lens, drivers may enter the intersection to make the movement permitted by the arrow but shall yield the right-of-way to vehicles and pedestrians proceeding from another direction on a green indication.

(c) Yellow. While the yellow lens is illuminated, waiting drivers shall not proceed and any driver approaching the intersection or a marked stop line shall stop at such point unless so close to the intersection that a stop cannot be made in safety; provided, however, that if a green arrow is illuminated at the same time, drivers may enter the intersection to make the movement permitted by such arrow.

(d) Red.

(1) Traffic facing a steady circular red signal alone shall stop at a clearly marked stop line, or if none, before entering the crosswalk on the near side of the intersection or if none, then before entering the intersection and shall remain at a stand until an indication to proceed is shown, except as allowed by chapter 89, section 8 of the General Laws.

(2) No driver of a vehicle facing a steady red indication in a traffic control signal shall make a right turn against such red or stop indication at the following intersections when a sign is erected at such intersections prohibiting such right turn:

Main Street, southbound at Merriam Avenue.

Merriam Avenue, east and westbound at Main Street.

Main Street, southbound at North Main Street.

North Main Street, northbound at Main Street.

Railroad Square, southbound at Main and Prospect Streets.

Main, West and Mechanic Streets, all approaches.

Mechanic Street, eastbound at Whitney Street.

Lindell Avenue, eastbound at Merriam Avenue.

Whitney Street, southbound at Water Street.

(e) Red and yellow. While the red and yellow lenses are illuminated together, drivers shall not enter the intersection, and during such time the intersection shall be reserved for the exclusive use of pedestrians.

(f) Flashing red. A flashing red lens shall indicate an intersection or pedestrian crosswalk in use or subject to use by entering.

(g) Flashing yellow. A flashing yellow lens shall indicate the presence of a hazard and drivers may proceed only with caution.

(h) Flashing green. A flashing green lens shall indicate an intersection or pedestrian crosswalk in use or subject to use by entering or crossing traffic. Drivers may proceed only with caution and shall be prepared to comply with a change in the signal to a red and yellow indication.

ARTICLE III.
STOPPING, STANDING AND PARKING.

Division 1.
Generally.

Sec. 13-24. In general.

In accordance with the provisions of chapter 40, section 22D of the General Laws (Tercentenary Edition) the city council of the city hereby enacts the following regulations authorizing the removal to a convenient place of vehicles parked or standing in such a manner, or in such areas as are hereinafter described on any way under the control of the city. Vehicles specifically exempt by chapter 40, section 22D shall not however be subject to such removal.

Sec. 13-24.1. Authorization of police.

The moving or towing of any vehicle under the provisions of this article shall be by and at the direction of the chief of police or such other officer(s) of the rank of sergeant or higher as he may from time to time designate.

Sec. 13-24.2. Fees.

The city council hereby imposes upon the owner of any vehicle moved or towed to a convenient place, under the provisions of this article the following fees:

(a) Removal or Towing Fee. Not to exceed that which is provided in or as authorized by statute law.

(b) Storage Fees. Not to exceed that which is provided in or as authorized by statute law.

Sec. 13-24.3. Liability for damage during removal or storage.

The contractor shall be liable to the owner for any damage arising out of negligence caused to a vehicle in the course of removal and storage.

Sec. 13-24.4. General prohibition– Towing zones.

No person shall stand or park or allow, permit or suffer any vehicle registered in his name to stand or park in any of the following places. Vehicles found in violation of the provisions of this section, except those specifically exempt by law, shall be removed to a convenient place under the direction of an officer of the police department and the owner of the vehicle so removed, or towed away, shall be liable to the cost of such removal and storage, if any, as set forth in section 13-24.2 of this article. The owner of any vehicle removed or towed away under the provisions of this section shall also be subject to the penalties provided in chapter 90, section 20A of the General Laws (Tercentenary Edition).

(a) Upon any way in such a manner as to impede the removal or plowing of snow or ice except vehicles parked in accordance with approved regulations governing all night parking.

(b) Within an intersection.

(c) Upon any sidewalk.

(d) Upon any crosswalk.

(e) Upon the roadway in a rural or sparsely settled district.

(f) Upon a roadway where parking is permitted unless both wheels on the right side of the vehicle are within twelve inches of the curb or edge of the roadway; except, that upon those streets which are designated as one-way streets vehicles shall be parked in the direction in which such vehicle is moving and with both wheels on one side of the vehicle within twelve inches of the curb. This shall not apply to streets or parts of streets where angle parking is required by this division.

(g) Upon any street or highway within twenty feet of an intersecting way, except alleys.

(h) In front of any alley, private road or driveway.

(i) Upon any street or highway within ten feet of a fire hydrant.

(j) On the roadway side of any vehicle stopped or parked at the edge or curb of the way.

(k) Upon any roadway where the parking of a vehicle will not leave a clear and unobstructed lane at least ten feet wide for passing traffic.

(l) In any municipal parking area for a period of time in excess of seventy-two consecutive hours.

Sec. 13-24.5. Parking prohibitions– Towing zone.

No person shall stand or park or allow, permit or suffer any vehicle registered in his name to stand or park on any of the ways or parts of ways hereinafter described and during the periods of time set forth. Vehicles found in violation of the provisions of this section, except those specifically exempted by law, shall be removed to a convenient place under the direction of an officer of the police department and the owner of the vehicle so removed, or towed away, shall be liable to the cost of such removal and storage, if any, as set forth in section 13-24.2 of this article. The owner of any vehicle removed or towed away under the provisions of this section shall also be subject to the penalties provided in chapter 90, section 20A of the General Laws (Tercentenary Edition).

(a) Arlington Street (east side) from the intersection of McKay Street one hundred twenty feet in a southerly direction.

(b) Arlington Street (east side) from the intersection of McKay Street one hundred twenty feet in a northerly direction.

(c) Arlington Street (west side) from the intersection of McKay Street one hundred twenty feet in a northerly direction.

(d) Main Street (east side) from Lakeside Avenue three hundred feet in a northerly direction, between the hours of 9:00 P.M. to 6:00 A.M.

(e) Main Street (east side) from the Town Line one hundred fifty feet in a southerly direction, between the hours of 2:00 A.M. to 6:00 A.M.

(f) Main Street (west side) from Ferdinand Passway to Lakeside Avenue, no parking anytime.

(g) Main Street (west side) from Chase Avenue to Pine Grove Avenue one hundred ninety-seven feet in a southerly direction, between the hours of 9:00 P.M. to 6:00 A.M.

(h) Kingman Drive (east side) from Granite Street in a southerly direction for a distance of one thousand one hundred fifty-two feet.

Sec. 13-24.6. Official traffic signs.

The provisions of section 13-24.5 shall be effective only during such time as a sufficient number of official traffic signs bearing the legend "Tow-Away Zone" are installed, erected, maintained and located so as to be visible to approaching drivers, said signs to be appended above or incorporated into the legend of parking prohibition signs.

Sec. 13-24.7. Police to keep record of towed vehicles.

The police department shall keep a record of all vehicles towed or removed under the provisions of this article. Such record shall be retained for one year and shall contain the following information:

(a) The registration of the vehicle;

(b) The location from which it was towed, and time and date of tow order;

(c) The location to which it was moved;

(d) The fee charged for towing;

(e) Name of towing contractor, if any;

(f) Name and rank of officer who authorized towing.

Sec. 13-25. Parking for sale prohibited.

It shall be unlawful for any person to park upon a street or highway any vehicle displayed for sale, nor shall any person stand or stop any vehicle or any device moved by human power upon any public way in the city for the purpose of selling or offering for sale any food, beverage or goods, wares or merchandise therein or therefrom; provided, that this section shall not prevent the stopping of vehicles or devices moved by human power of hawkers and peddlers at dwelling houses for the purpose of selling goods, wares or merchandise to occupants thereof in accordance with the provisions of chapter 101 of the General Laws and regulations made under authority thereof.

Sec. 13-26. All night parking.

It shall be unlawful for the driver of any vehicle, other than one acting in an emergency, to park such vehicle on any street for a period of time longer than one hour between the hours of 12:00 A.M. and 6:00 A.M. of any day during the winter parking ban.

The winter parking ban commences on December first, or the date of the first snow storm with an accumulation of at least three inches, whichever comes first, and terminates on April first.

Sec. 13-27. Unlighted parking.

In accordance with the provisions of chapter 90, section 7 of the General Laws, unlighted parking is permitted, wherever parking is not prohibited by this article, within the limits of the way in the following districts:

Church Street, between West Street and Merriam Avenue.

Columbia Street.

Depot Square.

Merriam Avenue, from Depot Square to Grove Avenue.

Monument Square, and the streets radiating from it as follows:

Central Street, to Union Street.

Main Street, to North Main Street.

Mechanic Street, to the New York, New Haven and Hartford Railroad track.

Park Street.

Pleasant Street, to Pearl Street.

West Street, to Gardner Place.

New Haven and Hartford Railroad track.

Sec. 13-28. Angle parking.

The city council shall determine upon what streets angle parking shall be permitted and shall mark or sign such streets or cause the same to be marked or signed.

(1) Angle parking allowed on Main Street (east side) from Lakeside Avenue four hundred fifty feet in a northerly direction.

Sec. 13-29. Handicapped parking spaces.

The city council shall determine the location of parking spaces on public ways reserved for vehicles owned and operated by a disabled veteran or handicapped person whose vehicle bears the distinguishing license plate authorized by section 2, chapter 90 of the General Laws of Massachusetts. Any vehicles parked in such spaces in violation of this section shall be subject to fines as set forth in section 13-33 of the revised ordinances and removal in accordance with Massachusetts General Laws, chapter 40, section 22D.

Reserved parking spaces pursuant to this section are established at the following locations:

One reserved space on Lancaster Street in front of St. Anna Rectory at Pole No. 28.

Sec. 13-35. Safety zones.

No person shall park a vehicle within twenty feet of either end of a safety zone which is located within thirty feet of the curb or edge of the roadway.

Sec. 13-36. Bus stops.

No person shall park a vehicle other than a bus in a bus stop, nor shall any person park a bus upon any street within a business district at any place other than a bus stop.

Sec. 13-37. Taxicab stands.

No person shall park a vehicle other than a taxicab upon any street within a business district in any taxicab stand for a period of time longer than five minutes except while actually engaged in loading or unloading; provided, that such loading and unloading does not exceed a period of time longer than fifteen minutes.

No person shall park a taxicab upon any street within a business district at any place other than the taxicab stands designated for the use of his taxicabs.

No person shall park a vehicle for longer than fifteen minutes at any time between 8:00 A.M. and 8:00 P.M. on the northeasterly side of High Street, beginning thirty-eight feet from the intersection of North Main Street for a distance of forty-eight feet in a northwesterly direction.

No person shall park a vehicle for longer than fifteen minutes at any time between 8:00 A.M. and 8:00 P.M. on the southwesterly side of Lancaster Street, beginning at a point forty feet from the intersection of Florence Street for a distance of forty-two feet in a northwesterly direction.

No person shall park a vehicle for longer than fifteen minutes at any time between 8:00 A.M. and 8:00 P.M. on the west side of Main Street between the intersection of Merriam Avenue and Main Street and the driveway of the post office on the west side of Main Street.

No person shall park a vehicle for longer than fifteen minutes at any time during the drop-off and pick-up times opposite the business at 420 Lancaster Street, on the south side of Lancaster Street between the intersections with Litchfield Street and Elm Hill Avenue.

Sec. 13-52.1. Ten-minute parking.

No person shall park a vehicle for longer than ten minutes at any time between 8:00 A.M. and 8:00 P.M. on the southerly side of Merriam Avenue, from one hundred seventy-one feet east of Main Street for seventy feet.

Division 4.
Metered Parking.

Sec. 13-53. Installation, maintenance and operation of meters.

The mayor is hereby authorized and empowered to contract in accordance with provisions of chapter 40 of the General Laws for the acquisition, installation and maintenance of parking meters provided for by this article.

The mayor shall also be authorized and empowered to install parking meters within the areas described in this division or cause the same to be installed. The meters shall be placed at intervals of not less than twenty feet apart and not less than fourteen inches from the face of the curb adjacent to individual meter spaces. Meters shall be so constructed as to display a signal showing legal parking upon deposit therein of the proper coin or coins of the United States as indicated by instructions on such meters and for such period of time as is or shall be indicated by this division. Such signal shall remain in evidence until expiration of the parking period designated, at which time a dropping of a signal automatically or some other mechanical operation shall indicate expiration of such parking period.

Sec. 13-54. Designation and marking of spaces.

The mayor is hereby authorized and empowered to establish or cause to be established parking meter spaces in such parking meter zones as are specified in this division or as may be hereafter fixed by ordinance and to indicate the same by white markings upon the surface of the highway. Nothing contained in this section shall be construed to prohibit the city council from making provisions for bus stops, taxicab stands, service zones and loading zones as authorized by other sections of this chapter on any street or portion of a street which has been or may hereafter be designated herein as a parking meter zone.

Sec. 13-55. Parking within spaces; fees.

Whenever any vehicle shall be parked adjacent to a parking meter, the owner or operator of such vehicle shall park within the space designated by street marking lines, upon entering such space shall immediately deposit or cause to be deposited in such meter the required coin of the United States for the maximum legal parking period or proportional period thereof as indicated or shown on the meter and, if so required, shall set the mechanism in motion.

The fee for the maximum time shall be in the amount designated on each meter.

Sec. 13-55.1. Parking in unmarked areas– Prohibited in municipal or off-street parking areas.

Whenever any vehicle shall be parked in a municipal or off-street parking area, such vehicle shall park within the spaces designated by marked pavement lines. Such lines will be drawn on a plan by the city engineer under the approval of the chief of police or his designee.

Any vehicle not so parked or parked in any other part of these areas where there are no pavement markings shall be in violation and shall be considered to be parked in a no parking zone.

Sec. 13-56. Deposit of additional coins to extend parking time prohibited.

It shall be unlawful for any person to deposit or cause to be deposited in a parking meter any coin for the purpose of permitting the vehicle of which he is in charge to remain in a parking meter space beyond the maximum period of time allowed in a particular zone.

Sec. 13-57. Parking outside of meter spaces.

It shall be unlawful for any person to park a vehicle within a parking meter space unless such vehicle is wholly within the painted lines adjacent to such meter.

Sec. 13-58. Tampering with, injuring, etc., meter; use of slugs, etc.

It shall be unlawful for any unauthorized person to tamper with, break, injure or destroy any parking meter or to deposit or cause to be deposited in such meter any slug, device or metallic substance or any other substitute for the coins required.

Sec. 13-59. Parking of commercial vehicles.

Operators of commercial vehicles may park in a metered space without depositing a coin for a period not to exceed thirty minutes for the purpose of loading or unloading. Parking in excess of this time limit without depositing the proper coin shall be deemed a violation of the provisions of this division.

Sec. 13-60. Collection and disposition of money.

It shall be the duty of the mayor to designate a person or persons to make regular collections of the money deposited in the parking meters, and it shall be the duty of such member so designated to remove from the parking meters the sealed containers therein containing the coins so deposited and to deliver such sealed containers with the seals unbroken to the city treasurer in a separate account to be known as the city parking meter account and designated in the ledger as parking meter fees.

All fees received by the city from the operation and use of parking meters shall be used as provided by chapter 40 of the General Laws.

Sec. 13-62. Parking meter zones– Two hours.

No person shall park a vehicle in a parking meter space for longer than two hours between 8 A.M. and 6 P.M. on any of the following streets or parts of streets on any day except Saturdays, Sundays and legal holidays: Central Street (west side), from a point one hundred feet southerly from the intersection with Pleasant Street to a point two hundred seventy-five feet from the intersection with Pleasant Street.

Central Street (west side), from a point three hundred forty-five feet from the intersection of Pleasant Street and Monument Square to a point three hundred ten feet from the intersection of Central and Union Streets.

Central Street (east side), from a point two hundred seventy-five feet from the southerly corner of Eaton Place and Lancaster Street and proceeding northerly along the easterly side of Central Street to a point thirty feet southerly from the intersection of Central Street and Manning Avenue.

Church Street (east side), from West Street to the police station.

Depot Square (west side), from twenty-five feet from Water Street north to Merriam Avenue.

Main Street (east and west sides), beginning at a point one hundred feet from the intersection of Main and Mechanic Streets and proceeding to a point eighty feet southerly from the intersection of Main Street and Merriam Avenue.

No person shall park a vehicle in a parking meter space for longer than one-half hour between 8:00 A.M. and 6:00 P.M., except on Thursday when the hours shall be from 8:00 A.M. to 9:00 P.M. on the north side of Mechanic Street, from twenty feet east of the intersection of Water and Mechanic Streets for one hundred fifty-two feet east.

Sec. 13-65. Enforcement of division.

It shall be the duty of the mayor's designee and the Leominster police chief to enforce any provisions of this division.

Sec. 13-66. Penalties.

Any person who violates any parking provisions of this article shall be subject to the penalties provided by section 13-33.

Division 5.
Off-Street Parking Zones.

Sec. 13-66.1. No-parking and two-hour parking zones established.

(a) A no-parking zone is hereby established in the area described in this section during the hours of 7:00 A.M. to 9:30 A.M., Monday through Friday.

(b) Two-hour parking is established in the Manning Avenue Municipal Parking Area.

(c) Two-hour parking is hereby established in the Merriam Avenue-Colbum Court off-street parking area, Monday through Friday, and unrestricted parking during Saturdays and from June 15th to August 30th, inclusive.

Sec. 13-66.2. One-half hour parking zones established.

"Beginning at a point 10 feet east of an angle in the southerly sideline of Mechanic Street, said angle being opposite Water Street; thence South 61° 30' East 104 feet along the southerly sideline of said Mechanic Street to an angle; thence South 28° 30' West 60 feet to an angle; thence North 61° 30' West 104 feet to an angle; thence North 28° 30' East 60 feet to the place of beginning."

Sec. 13-66.7. No parking outside of designated spaces.

No person shall park a motor vehicle in an off-street parking area outside of a space designated by marked pavement lines approved by the chief of police.

Sec. 13-66.8. Handicapped parking.

(a) Any person or body that has lawful control of a public or private way or of improved or enclosed property used as off-street parking areas for businesses, shopping malls, theaters, auditoriums, sporting or recreational facilities, cultural centers, residential dwellings, or for any other place where the public has a right of access as invitees or licensees, shall be required to reserve parking spaces in said off-street parking areas for any vehicle owned and operated by a disabled veteran or handicapped person whose vehicle bears the distinguishing license plate authorized by section 2 of chapter 90 of the General Laws of Massachusetts and according to the following formula:

If the number of parking spaces in any such area is more than fifteen but not more than twenty-five, one parking space; more than twenty-five but not more than forty, five percent of such spaces but not less than two; more than forty but not more than one hundred, four percent of such spaces but not less than three; more than one hundred but not more than two hundred, three percent of such spaces but not less than four; more than two hundred but not more than five hundred, two percent of such spaces but not less than six; more than five hundred but not more than one thousand, one and one-half percent of such spaces but not less than ten; more than one thousand but not more than two thousand, one percent of such spaces but not less than fifteen; more than two thousand but less than five thousand, three-fourths of one percent of such spaces but not less than twenty; and more than five thousand, one-half of one percent of such spaces but not less than thirty.

(b) Parking spaces designated as reserved under the provisions of paragraph (a) shall be identified by the use of above grade signs with white lettering against a blue background and shall bear the words "Handicapped Parking: Special Plate Required. Unauthorized Vehicles May be Removed at Owner's Expense"; shall be as near as possible to a building entrance or walkway; shall be adjacent to curb ramps or other unobstructed methods permitting sidewalk access to a handicapped person; and shall be twelve feet wide or two eight-foot wide areas with four feet of cross hatch between them.

(c) No person shall leave an unauthorized vehicle within parking spaces designated for use by disabled veterans or handicapped person or in such manner as to obstruct a curb ramp designed for use by handicapped persons as a means of egress to a street or public way.

Sec. 13-66.9. Electronic metered parking.

The mayor is hereby authorized and empowered to contract in accordance with provisions of chapter 40 of the General Laws for the acquisition, installation and maintenance of parking meters provided for by this article.

The mayor shall be also authorized and empowered to install electronic parking meters within the area described in this division or cause the same to be installed. The meters shall be placed in spaces designated by the mayor in that part of the Merriam Avenue and Colburn Court parking area, bounded and described as follows:

Beginning at a point on the northeasterly sideline of Colburn Court, said point being North 50° 12' west 135.59 feet from the northwesterly sideline of Main Street; thence south 40° 03' west 140.00 feet to an angle; thence north 47° 02' east 50.00 feet to an angle; thence north 40° 03' east 140.00 feet to an angle; thence south 50° 12' east 50.00 feet to the place of beginning.

The mayor is also hereby authorized and empowered to establish a plan for permit parking within the parking area bounded and described in the preceding paragraph.

Sec. 13-66.10. Designation and marking of spaces.

The mayor is hereby authorized and empowered to establish or cause to be established parking meter spaces within the Colburn and Merriam Avenue area as specified in this division or as may be hereafter fixed by ordinance and to indicate the same by white markings upon the surface of the highway. Nothing contained in this section shall be construed to prohibit the city council from making provisions for bus stops, taxicab stands, service zones and loading zones as authorized by other sections of this chapter on any portion of the enclosed parking.

Sec. 13-66.11. Parking within spaces; fees.

Whenever any vehicle shall enter that part of the Merriam Avenue and Colburn Street parking area the owner or operator of such vehicle shall park within the space or spaces designated by street marking lines. Upon entering said parking area shall immediately deposit or cause to be deposited in such meter the required coin of the United States for the legal parking period or proportional period thereof as indicated or shown on the meter and, if so required, shall set the mechanism in motion.

The fee for the selected time shall be in the amount designated on each meter.

Such a meter deposit shall not be required if the owner or operator of the vehicle has been issued a permit to park in said area and the permit is conspicuously displayed upon the vehicle, in accordance with the plan for permit parking established by the mayor.

Sec. 13-66.12. Parking in unmarked areas– Prohibited in municipal off-street areas.

Whenever any vehicle shall be parked in a municipal or off-street parking area known as the Colburn and Merriam Avenue area or within the spaces designated by marked pavement lines. Such lines will be drawn on a plan by the city engineer under the approval of the chief of police or his designee.

Any vehicle not so parked or parked in any other part of those areas where there are no pavement markings or signs shall be in violation and shall be considered to be parked in a no parking zone.

Sec. 13-66.13. Tampering with, injuring, etc.– Meter use of slugs, etc.

It shall be unlawful for any unauthorized person to tamper with, break, injure or destroy any parking meter or to deposit or cause to be deposited in such meter any slug, device or metallic substance or any other substitute for the coins required.

Sec. 13-66.14. Collection and disposition of money.

It shall be the duty of the mayor to designate a person or persons to make regular collections of the money deposited in the parking meters, and it shall be the duty of such members so designated to remove from the parking meters the sealed containers therein containing the coins so deposited and to deliver such sealed containers with the seals unbroken to the city treasurer or designated bank in a separate account to be known as the city parking meter account and designated in the ledger as parking meter fees.

All fees received by the city from the operation and use of parking meters shall be used as provided by chapter 40 of the General Laws.

Sec. 13-66.15. Enforcement of division.

It shall be the duty of the mayor's designee and Leominster police chief to enforce any provision of this division.

Sec. 13-66.16. Penalties.

Any person who violates any parking provision of this article shall be subject to the penalties provided by section 13-33.

ARTICLE IV.
OPERATION OF VEHICLES.

Sec. 13-67. Speed.

No person operating a motor vehicle on any way shall run it at a rate of speed greater than is reasonable and proper, having regard to traffic and the use of the way and the safety of the public. Unless a way is otherwise posted in accordance with Massachusetts General Laws, chapter 90, section 18, it shall be prima facie evidence of a rate of speed greater than is reasonable and proper as aforesaid (1) on any other way outside a thickly settled or business district at a rate of speed exceeding forty miles per hour for a distance of one-quarter of a mile, or (2) inside a thickly settled or business district at a rate of speed exceeding thirty miles per hour for a distance of one-eighth of a mile, or (3) within a school zone established by the city as provided in Massachusetts General Laws, chapter 85, section 2, at a rate of speed exceeding twenty miles per hour. If a speed limit has been duly established upon any way, operation of a motor vehicle at a rate of speed in excess of such limit shall be prima facie evidence that such speed is greater than reasonable and proper.

Sec. 13-68. Keeping to the right.

Upon all roadways the driver of a vehicle shall drive in the lane nearest the right side of the roadway when such lane is available for travel except when overtaking another vehicle or when preparing for a left turn.

Upon such roadways as are divided by a parkway, grass plot, preservation viaduct, subway or any other structure or area, drivers shall keep to the right of such a division except when otherwise directed by an officer, signs, signals or markings.

Sec. 13-69. Overtaking and passing.

The driver of a vehicle shall not overtake and pass a vehicle proceeding in the same direction unless there is sufficient clear space ahead on the right side of the roadway to permit the overtaking to be completed without impeding the safe operation of any vehicle ahead. Any person convicted of a violation of this rule shall be punished by a fine of fifty dollars for each offense.

Sec. 13-70. Driver to give way to overtaking vehicle.

The driver of a vehicle when about to be overtaken and passed by another vehicle approaching from the rear shall give way to the right in favor of the overtaking vehicle on suitable and audible signal being given by the driver of the overtaking vehicle and shall not increase the speed of his vehicle until completely passed by the overtaking vehicle.

Sec. 13-71. Obstructing traffic prohibited.

No person shall drive in such a manner as to obstruct unnecessarily the normal movement of traffic upon any street or highway. Officers are hereby authorized to require any driver who fails to comply with this section to drive to the side of the roadway and wait until such traffic as has been delayed has passed.

No driver shall enter an intersection or a marked crosswalk unless there is sufficient space on the other side of the intersection or crosswalk and on the right half of the roadway to accommodate the vehicle he is operating without obstructing the passage of other vehicles or pedestrians notwithstanding any traffic control signal indication to proceed.

Sec. 13-72. Following too closely.

The driver of a vehicle shall not follow another vehicle more closely than is reasonable and prudent, having due regard to the speed of such vehicle and the traffic upon and condition of the street or highway.

Sec. 13-73. Slow vehicles to stay two hundred feet apart.

Upon roadways less than twenty-seven feet wide and upon which vehicular traffic is permitted to operate in both directions, the driver of any slow moving vehicle when travelling outside of a business or residential district shall not follow another slow moving vehicle within two hundred feet; provided, that this section shall not be construed to prevent such slow moving vehicle from overtaking and passing another slow moving vehicle; provided further, that this section shall not apply to funerals or other lawful processions.

Sec. 13-74. Procedure for stopping, turning, etc.

The driver of any vehicle before starting, stopping, or turning from a direct line or backing shall first see that such movement can be made in safety. If the operation of another vehicle should be affected by a stopping or turning movement, the driver of such vehicle shall be given a plainly visible signal as required by the following section.

Sec. 13-80. Emerging from alley, driveway, etc.

The driver of a vehicle emerging from an alley, driveway or garage shall stop such vehicle immediately prior to driving onto a sidewalk or sidewalk area extending across such alley or driveway or the exit from such garage. Any person convicted of a violation of this rule shall be punished by a fine of fifty dollars for each offense.

Sec. 13-81. Driving upon closed street prohibited.

No operator shall enter upon the road surface of any street or highway or section thereof when, by reason of construction, surface treatment, maintenance or the like or because of some unprotected hazard, such road surface is closed to travel and one or more signs, lights or signals have been erected to indicate that all or part of the road surface of the street or highway is not to be used or when so advised by an officer, watchman, member of a street or highway crew or employee of the city, either audibly or by signals.

Sec. 13-82. Driving on sidewalks.

The driver of a vehicle shall not drive upon any sidewalk except at a permanent or temporary driveway. Any person convicted of a violation of this rule shall be punished by a fine of fifty dollars for each offense.

Sec. 13-83. Driving through safety zones.

It shall be unlawful for the driver of a vehicle, except on signal from a police officer, to drive such vehicle over or through a safety zone.

Sec. 13-84. Identification of funeral processions.

A funeral composed entirely or partly of a procession of vehicles shall be identified as such by means of black pennants bearing a purple cross or other suitable insignia attached to both the first and the last vehicles.

Sec. 13-85. Operation of vehicles in funeral or other processions.

(a) It shall be the duty of each driver in a funeral or other procession to keep as near to the right edge of the roadway as is feasible and to follow the vehicle ahead as closely as is practicable and safe.

(b) At an intersection where a traffic control signal is operating, the driver of the first vehicle in a funeral or other procession shall be the only one required to stop for a red or red and yellow indication.

(c) At an intersection where a lawful stop sign exists, the driver of the first vehicle in a funeral or other procession shall be the only one required to stop before proceeding through the intersection.

(d) At an intersection where a lawful yield sign exists, the driver of the first vehicle in a funeral or other procession shall be the only one to yield the right-of-way before proceeding through the intersection as provided in section 13-78.

Sec. 13-86. Heavy commercial vehicles excluded.

The use and operation of heavy commercial vehicles having a carrying capacity of more than two and one-half tons is hereby excluded on the following named streets or parts thereof:

Harvard Street, between Stagecoach Road and Orchard Hill Park Drive Stagecoach Road, between Harvard Street and Prospect Street.

Exemptions. This section shall not apply to heavy commercial vehicles going to or coming from locations upon said streets for the purpose of making deliveries of goods, materials or merchandise to or similar collections from abutting land or buildings or adjoining streets or ways to which access cannot otherwise be gained; or to vehicles used in connection with the construction, maintenance or repair of said streets or public utilities therein, or to federal, state, municipal or public service corporation owned vehicles.

The provisions of this section shall apply only when sufficient standard signs have been erected.

Sec. 13-87. Intersections with islands, ramps, etc.

At any junction or crossing of ways where the roadway grades have been separated and where the ways are connected by ramps and at any intersection of ways in which there are traffic islands, drivers of vehicles shall proceed only as indicated by official signs, signals or markings.

Sec. 13-88. Left turn prohibition.

No driver of a vehicle shall make a left turn at the intersections listed below and in the direction specified:

Sec. 13-89. U-turns.

No driver shall back or turn a vehicle so as to proceed in the direction opposite to that in which such vehicle is heading or traveling on the following streets:

Main Street, from West Street to Summer Street.

ARTICLE V.
ABANDONED AND JUNKED MOTOR VEHICLES.

Sec. 13-90. Definitions.

For the purposes of this article, the following words and phrases shall have the meanings respectively ascribed to them by this section:

Property. Any real property within the city which is not a street or highway.

Street or highway. The entire width between the boundary lines on every way publicly maintained when any part thereof is open to the use of the public for purposes of vehicular travel.

Vehicle. A machine propelled by power other than human power which is designed to travel along the ground by use of wheels, treads, runners or slides and to transport persons or property or pull machinery. The word "vehicle" shall include without limitation any automobile, truck, trailer, motorcycle, tractor, buggy or wagon.

Sec. 13-91. Abandonment prohibited.

(a) Except as to vehicles for which other provisions are made under the laws of the commonwealth, no person shall abandon any vehicle or leave any vehicle at any place within the city for such time and under such circumstances as to cause such vehicle reasonably to appear to have been abandoned, nor shall any person leave any partially dismantled, nonoperating, wrecked or junked vehicle on any street or highway within the city.

(b) No person in charge or control of any property within the city, whether as owner, tenant, occupant, lessee or otherwise, shall allow any partially dismantled, nonoperating, wrecked, junked or discarded vehicle to remain on any property within the city for more than a period of thirty days after he has received a notice from the office of the building inspector of the existence of such partially dismantled, nonoperating, wrecked, junked or discarded vehicle, such notice to be given in hand or by registered mail, return receipt requested; except to a vehicle in an enclosed building; a vehicle on the premises of a business enterprise operated in a lawful place and manner, when necessary to the operation of such business enterprise; or a vehicle in an appropriate storage place or depository maintained in a lawful place and manner by the city. This section shall not apply to Class three licenses under General Laws, chapter 140, section 58.

Sec. 13-91A. Unregistered motor vehicles.

(a) Not more than one unregistered motor vehicle, assembled or disassembled, shall be kept, stored or allowed to remain on a parcel of land except by a person duly licensed under Massachusetts General Laws, chapter 140, section 59, or except as provided in subsection (b) of this section. For purposes of this section all contiguous lots of land in common ownership shall be considered one parcel of land.

(b) One additional unregistered motor vehicle, assembled or disassembled, may be kept, stored, or allowed to remain on a parcel, provided that not more than one such additional unregistered motor vehicle may be kept, stored, or allowed to remain on a parcel for more than a total of thirty days in any one calendar year.

(c) Violation of this chapter shall be punished by a fine of fifty dollars for the first offense, and one hundred dollars for each subsequent offense. Each day that a violation exists or continues on a parcel shall be deemed a separate offense. This chapter may be enforced by any police officer of the city of Leominster.

Sec. 13-92. Impoundment.

The chief of police or any member of his department designated by him, upon notice from the building inspector or superintendent of streets, is hereby authorized to remove or have removed any vehicle left at any place within the city which reasonably appears to be in violation of this article, lost, stolen or unclaimed. Such vehicle shall be impounded until lawfully claimed or disposed of in accordance with General Laws, chapter 135 relative to unclaimed and abandoned property.

ARTICLE VI.
PEDESTRIAN CONTROL REGULATIONS.

Sec. 13-93. Definitions.

For the purposes of this article, the following words and phrases shall have the meanings respectively ascribed to them herein, unless the text clearly indicates otherwise:

Intersection. The area embraced within the extensions of the lateral curb lines, or if none, then the lateral boundary lines, of intersecting ways as defined in section 1 of chapter 90 of the General Laws of the state, including divided ways.

The rules and regulations herein contained governing and restricting the movement of vehicles at and near intersecting ways shall apply at any place along any way at which drivers are to be controlled by traffic-control signals, whether or not such place is an intersection as herein defined.

Vehicle. Every device in, upon or by which any person or property is or may be transported or drawn upon a highway, including bicycles when the provisions of these rules are applicable to them, except other devices moved by human power or used exclusively upon stationary rails or tracks and devices which derive their power for operation from stationary overhead wires.

Sec. 13-94. Obedience to officers, signals and markings required; crosswalk markings described.

Pedestrians shall obey the directions of police officers directing traffic, and whenever there is an officer directing traffic, a traffic-control signal or a marked cross walk within three hundred feet of a pedestrian, no such pedestrian shall cross a way or roadway except within the limits of a marked crosswalk and as hereinafter provided in these regulations. For the purpose of these regulations, a marked crosswalk shall only be construed to be that area of a roadway reserved for pedestrian crossing located between two solid white reflectorized twelve-inch pavement markings in rural areas or markings not less than six inches wide in urban areas, such markings or lines being no less than six feet apart.

Sec. 13-95. Traffic-control signals– Pedestrian actuation; right-of-way of certain vehicles.

(a) At a traffic-control signal location where pedestrian indications are provided but which are shown only upon actuation by means of a pedestrian push button, no pedestrian shall cross a roadway unless or until the pedestrian-control signal push button has been actuated, and then cross only on the proper pedestrian signal indication. At traffic-control signal locations where no pedestrian indication is provided, pedestrians shall cross only on the green indication. If necessary, the green indication shall be actuated by the pedestrian by means of a push button.

(b) At a traffic-control signal location, pedestrians shall yield the right-of-way to vehicles of a funeral or other procession or authorized emergency vehicle while in performance of emergency duties regardless of the signal indication given, and they shall not attempt to cross the roadway until such vehicles or procession has passed at which time pedestrians shall then cross the roadway only as provided in these regulations.

Sec. 13-96. Same– Color indications and legends; compliance required.

Traffic-control signal color indications and legends shall have the commands ascribed to them in this section and no other meanings, and every pedestrian shall comply therewith, except when otherwise directed by an officer.

(a) Red and yellow or the word "walk." Whenever the red and yellow lenses are illuminated together or the single word "walk" is illuminated, pedestrians facing such indication may proceed across the roadway and in the direction of such signal only.

(b) Red alone or "don't walk." Whenever the words "don't walk" or any indication other than red and yellow shown together are illuminated in a traffic control signal where pedestrian indications are provided, pedestrians approaching or facing such indication shall wait on the sidewalk, edge of roadway or in the pedestrian refuge area of a traffic island and shall not enter upon or cross a roadway until the proper indication is illuminated in the traffic control signal; but any pedestrian who has partially completed his crossing on the "walk" indication shall proceed or return to the nearest sidewalk or safety island on the yellow indication, the red indication or when the words "don't walk" are illuminated by rapid intermittent flashes.

(c) Green alone. At traffic-control signal locations where no pedestrian indication is given or provided, pedestrians facing the signal may proceed across the roadway within any marked crosswalk in the direction of the green indication.

(d) Yellow alone, red alone or flashing "don't walk." Pedestrians approaching or facing a yellow, red or flashing "don't walk" illuminated indication shall not start to cross a roadway.

(e) Flashing red, yellow or green. At any traffic control signal location where a flashing red, flashing yellow or flashing green indication is being given facing a crosswalk, pedestrians shall actuate, where provided, the pedestrian signal indication and cross the roadway only on the red-yellow or "walk" indication when such indication is in operation. If no pedestrian signal is provided, pedestrians shall cross within crosswalks with due care.

Sec. 13-97. Pedestrian crossings and use of roadways– Generally.

(a) No pedestrian shall suddenly leave a sidewalk or safety island and walk or run into the path of a vehicle which is so close that it is impossible for the driver to yield the right-of-way.

(b) Pedestrians shall attempt, at all times, to use the right half of crosswalks when crossing a roadway.

(c) Where sidewalks are provided, it shall be unlawful for any pedestrian to walk along and upon an adjacent roadway whenever the sidewalk is open to pedestrian use.

(d) Where sidewalks are not provided, any pedestrian walking along and upon a highway shall, when practicable, walk only on the left side of the roadway on its unfinished shoulder facing traffic which may approach from the opposite direction.

(e) Persons alighting from the roadway side of any vehicle parked at the curb or edge of roadway shall proceed immediately to the sidewalk or edges of roadway adjacent to vehicle, and shall cross the roadway only as authorized by these regulations.

(f) It shall be unlawful for any person to actuate a pedestrian control signal or to enter a marked crosswalk unless a crossing of the roadway is intended.

Sec. 13-98. Same– At nonsignalized locations.

Every pedestrian crossing a roadway at any point other than within a marked crosswalk shall yield the right-of-way to all vehicles upon the roadway. At a point where a pedestrian tunnel or overpass has been provided, pedestrians shall cross the roadway only by the proper use of the tunnel or overpass.

Sec. 13-99. Vehicle operators to exercise due care.

The provisions of these regulations shall in no way abrogate the provisions of chapter 90, sections 14 and 14A of the General Laws of the state (ter. ed.) which provide: "Precautions for Safety of Other Travelers" and for the "Protection of Blind Persons Crossing Ways." Furthermore, notwithstanding the provisions of these regulations, every operator of a vehicle shall exercise due care to avoid colliding with any pedestrian upon the roadway and shall give warning by sounding the horn when necessary and shall exercise proper precautions which may become necessary for safe operation.

Sec. 13-100. Permit required for solicitation of rides or business.

No person shall stand in a roadway for the purpose of soliciting a ride, employment or business from the operator or occupant of any vehicle without the written permission of the board or officers having control of such roadway or highway.

Sec. 13-101. Enforcement of article.

This article shall be enforced by all officers of the city.

Sec. 13-102. Article not applicable to certain persons.

The provisions of this article shall not apply to pedestrians actually engaged in work upon a roadway closed to travel or under construction or repair, to municipal, state, federal or public service corporation employees while in the performance of their duties, to police officers engaged in the performance of their public duties or to pedestrians acting in an emergency when such emergency necessitates departure from any part of these rules and regulations.

Sec. 13-103. Penalties for violation of article.

(a) It shall be the duty of the mayor, or his designee relative to parking, the chief of police and the officers of the police department to enforce the provisions of this chapter. Any person convicted of a violation of any provision of this article relative to the operation of vehicles shall be punished by a fine consistent with the penalty provisions of this chapter.

(b) Any person convicted of a violation of section 67, shall be punished by a fine of not less than fifty dollars. Where said conviction is for operating a vehicle at a rate of speed exceeding ten miles per hour over the speed limit for the way upon which the person was operating, an additional fine of ten dollars for each mile per hour in excess of the ten miles per hour shall be assessed.

(c) The chief of police and the officers of the police department may, as an alternative to initiating criminal proceedings, seek the noncriminal disposition of any violation, by following the procedures set forth in section 21D of chapter 40 of the General Laws.
