ARTICLE I. Sec. 16-1. Salary Mayor.
The salary of the mayor shall be fifty thousand dollars per year, and he shall receive no other compensation from the city for any official duty.
Such salary shall be increased to sixty thousand dollars effective January 1, 2006; seventy thousand dollars effective January 1, 2007; and seventy-five thousand dollars effective January 1, 2008. Effective January 1, 2009 and on an annual basis thereafter, a percentage increase of the mayoral salary will be established consistent with the annual consumer price index (CPI-U) of the previous calendar year, with a minimum of no increase and a maximum increase of five per cent.

Sec. 16-2. Same City council.
The salary of each member of the city council shall be seven thousand dollars per year. Such salary shall be increased to eight thousand five hundred dollars effective January 1, 2008, and shall be further increased to ten thousand dollars effective July 1, 2008. Effective January 1, 2009 and on an annual basis thereafter, a percentage increase of the city councilor salary will be established consistent with the annual consumer price index (CPI-U) of the previous calendar year, with a minimum of no increase and a maximum increase of five percent.

Sec. 16-3. Same Officers, department heads, etc., appointed by mayor or council.
All officers, heads of departments and members of boards appointed by the mayor or elected by the city council, excepting those under the provisions of article II, shall receive such salary or compensation as may be determined by the mayor and approved by the city council.

Sec. 16-4. Same Other officers, clerks, etc.
The compensation of all officers, clerks, assistants and other employees, excepting those under the provisions of article II, shall be fixed by the boards or officers making their appointment subject to the provisions of section 31 of chapter 44 of the General Laws.

Sec. 16-5. Collection and disposition of fees.
All officials or employees of the city receiving a salary or other compensation and entitled by law to receive fees shall collect all such fees and once during each month, unless otherwise provided by law, shall deposit the same with the city treasurer, filing, at the same time, a statement of such deposit with the city accountant.

Sec. 16-6. Receipt of fees for services rendered.
All officials and employees not receiving a salary or compensation from the city and entitled by law to receive fees for services rendered may retain such fees in full compensation for their services.

ARTICLE II. Division 1. Sec. 16-7. Director of personnel and labor service.
(a) There is established the position of director of personnel and labor service. Such director shall be subject to the authority and direction of the mayor. The director of personnel and labor service shall in that capacity be responsible for carrying out the provisions of the city's classification plan as set forth in section 16-34 of this chapter; shall be responsible for compliance with the city's affirmative action policies; shall make recommendations and be responsible for the classification and reclassification of employment positions or groups or classes of employment positions within the city; shall, subject to the above and to the authority of each appointing authority, be responsible for labor relations; and shall maintain and keep informed as to job descriptions, wage and salary and fringe benefit records in the city and of comparable positions in the public and/or private labor sectors.
(b) An appointing authority within the city requiring the filling of a position shall file completed and proper Civil Service forms with the director of personnel and labor service who shall process such requests in accordance with procedures established by Civil Service.
(c) Prior to an appointing authority filling any open position, the director of personnel and labor service shall determine that there are sufficient funds appropriated to cover the requested position(s) and that the classification of the subject position(s) are in accordance with the Class Titles listed in section 16-34 of this chapter, and shall so certify to the appointing authority.
(d) The director of personnel and labor service shall be appointed by the mayor in accordance with the Leominster Home Rule Charter for a term of three years.

Sec. 16-10. Same Personnel records.
A personnel record of all city employees, including both elected and appointed employees, shall be kept by the city comptroller in his office. Such records shall contain all the vital statistics of each and every person employed by the city. It shall be the duty of each city official and employee to furnish the city comptroller with all data needed for the completion of this record and such personnel records as the personnel board may require. Each department head shall submit to the city comptroller on the first Monday of each month, in such form as the personnel board shall prescribe, a report of all officers and employees of the department absent from duty during the calendar month immediately preceding, specifying in each case whether the officer or employee was absent on vacation leave, on leave of absence, on workmen's compensation sick leave, on nonoccupational sick leave, on bereavement leave, on jury duty or on military leave or specifying the nature of his absence if it was not for one of the foregoing reasons.

Sec. 16-11. Employment, promotion and transfer of employees.
No person shall be appointed, transferred or promoted to any position in the city's service which is subject to chapter 31 of the General Laws unless such appointment, transfer or promotion is in compliance with the provisions of such law and the rules and regulations made thereunder. Before making any such appointment, transfer or promotion, the appointing authority shall notify the personnel director in such form as may require of his intent to appoint, transfer or promote an employee. In the case of an appointment, promotion or transfer of personnel not subject to the provisions of civil service, the department head shall notify the personnel director of his intent to appoint, transfer or promote such employee. The oath or affirmation required of persons entering the employ of the city by section 14 of chapter 264 of the General Laws shall be kept on file in the office of the city clerk.

Sec. 16-11a. Vacancy filling.
When a position is vacated due to retirement, termination, death, or other reason the position shall not be filled by any appointing authority, unless approval for filling such position is voted by the city council by a majority vote.

Sec. 16-12. Medical examinations.
Every applicant for permanent employment shall be certified by a practicing physician designated by the city as to his or her physical fitness to perform the duties of the position to which such applicant seeks appointment. The certification required hereunder shall be in such form as the board shall determine. The cost of such physical examination shall be paid by the city.

Sec. 16-13. Vacations.
Each department head shall annually, after the first day of January in each year, develop a vacation schedule for all employees in his department who are or may become eligible to receive vacation during the year. Such department head shall schedule vacations over as wide a period as possible in order to obviate the need for temporary increases in the personnel of his department and may amend such schedule as it shall become necessary. Vacation leave shall not be cumulative from one year to another; provided, however, that if the vacation leave of an employee scheduled to take his vacation in the month immediately preceding the date on which such employee earned vacation credits are due to expire and is cancelled by the department to meet an emergency or to offset a critical shortage of personnel in the department during such month, the amount of such vacation leave may, with the approval of the personnel board, be added to the amount of vacation leave which such employee shall be eligible to receive in the year immediately following. Additional vacation leave of one day at prorated vacation pay shall be allowed for each holiday occurring within a vacation period.
Vacations shall be granted as follows:
(a) Contract provisions shall govern vacation benefits for all employees covered by approved agreements between the city and recognized labor organizations.
(b) (1) Effective January 1, 2006, all other employees who have five years of full-time service shall be entitled to three weeks of vacation during the twelve-month period from his or her anniversary start date.
(2) Effective January 1, 2006, all other employees who have ten years of full-time service shall be entitled to four weeks of vacation during the twelve-month period from his or her anniversary start date.
(3) a. Effective January 1, 2006, all other employees who have fifteen years of full-time service shall be entitled to five weeks of vacation during the twelve-month period from his or her anniversary start date.
b. Effective January 1, 2006, all other employees who have twenty years of full-time service shall be entitled to six weeks of vacation during the twelve-month period from his or her anniversary start date.
(4) Officers and employees whose employment is terminated by retirement, resignation or death without having been granted a vacation to which he is entitled shall be paid in accordance with sections 111-E and 111-I of chapter 41 of the General Laws of the state.
(5) Part-time permanent employees, including employees provisionally appointed to part-time permanent positions subject to the civil service law, shall be entitled to the amount of vacation leave in the ratio that his part-time employment bears to full-time employment.
(6) The library director shall be entitled to four weeks vacation during a calendar year.
(7) All other professional library personnel with at least a master's degree in library science who were employed prior to January 1, 1986 shall be entitled to four weeks vacation during a calendar year. Professional library personnel employed subsequent to December 31, 1985 shall be granted vacations in accordance with the other provisions of this section.
(8) Employees entitled to four or more weeks vacation in a calendar year may buy back up to ten days of vacation time effective July 1, 2006.

Sec. 16-14. Leave of absence generally Court leave.
Except as otherwise provided in this article, all leaves of absence shall be without compensation and shall be subject to the approval of the department head and in compliance with chapter 31 of the General Laws, when applicable. In case such leave shall exceed a period of two weeks, it shall be subject to the approval of the personnel board.
Court leave of absence shall be granted to any city employee who is called to serve upon a jury or is summoned to appear in court as a witness, defendant or litigant. If the jury or witness fees exclusive of travel allowance received by an employee or officer shall be less than the regular rate of compensation received by him from the city, the difference between such fees and such regular rate of compensation shall be paid to such employee or officer by the city; provided, however, that to qualify for any payment by the city, such employee or officer must furnish the city accountant with complete and satisfactory evidence of the jury or witness fees paid. When court leave is granted to an officer or employee to appear in court as a defendant or litigant, it shall be granted without pay; provided, however, that such officer or employee may, with the approval of the department head, substitute one day of court leave with pay for one day of vacation leave with pay not to exceed the total number of days of vacation leave due such officer or employee.

Sec. 16-14a. Military leave of absence.
Military leave of absence shall be granted to any city employee who is called to active duty by the United States military. If the military pay received by an employee or officer shall be less than the regular rate of compensation received by him from the city, the difference between such fees and such regular rate of compensation shall be paid such employee or officer by the city; provided, however, that to qualify for any payment by the city, such employee or officer must furnish the city accountant with complete and satisfactory evidence of the military pay received. Said employee shall continue to accrue sick leave, vacation leave, and seniority during the period in which he is engaged in active duty. Said employee shall be eligible to participate in the city's health insurance program while on active duty; provided, however, that said employee is enrolled in said program prior to being called to serve on active duty.

Sec. 16-15. Holidays.
Every employee occupying a full-time position and every employee occupying a part-time position who regularly works more than sixteen hundred hours per year in such position shall be entitled to holidays as provided in this Revision. Every employee paid on an hourly basis shall be paid one day's pay at his regular straight time rate for each regularly observed holiday falling on Monday, Tuesday, Wednesday, Thursday or Friday or within the employee's designated work week. Such payment shall be based on the number of hours regularly worked by the employee on the day on which the designated holiday occurs. Every employee not paid on an hourly basis shall be granted each designated holiday without loss in pay. Payments shall be made only if the eligible employee shall have worked on the regularly scheduled work day next preceding or next following each designated holiday.
When one of the observed holidays falls on a Saturday, the Friday preceding that Saturday will be granted as a non-work day to eligible employees, in lieu of the designated holiday. When one of the observed holidays falls on a Sunday, the Monday following that Sunday will be granted as a non-work day to eligible employees, in lieu of the designated holiday.
The provisions of this section shall not apply to police officers and firefighters.

Sec. 16-15a. Personal time.
All nonunion personnel shall receive two personal days per year.

Division 2. Sec. 16-16. Eligibility.
Permanent employees shall be entitled to benefits under the provisions of this division.
Provisionally appointed employees under civil service rules, who are regularly employed in their positions continuously for at least six months are entitled to sick leave benefits.

Sec. 16-17. When authorized.
A leave of absence granted under this division shall be known as sick leave and shall be granted for the following reasons only:
(a) Personal illness or physical incapacity to such an extent as to be unable to perform the duties of his position.
(b) Attendance upon members of the family within the household of the employee whose illness requires the care of such employee; provided, that not more than seven working days with pay shall be granted to such employee for this purpose in any one calendar year, not to exceed earned sick leave available.
(c) Enforced quarantine when established and declared by the department of health or other competent authority for the period of such quarantine only and not to exceed earned sick leave available.

(d) Death of a mother, father, husband, wife, child, brother or sister or other member of the household of the employee or his spouse. In such cases, three days leave shall be granted. Notwithstanding any other provisions of this division, the leave provided by this subsection shall not be chargeable to sick leave.
(e) Death of other relatives; provided, that in such cases the leave with pay shall be for not more than one day to permit attendance at the funeral of such person.

Sec. 16-18. Amount Generally.
Sick leave with full pay for permanent employees shall be one and one quarter working days for each month. Such annual sick leave of fifteen days with pay, when not used, shall be cumulative indefinitely.
A part-time employee with permanent status will be allowed such proportion of sick leave credit as the actual part-time service bears to full-time service.

Sec. 16-18A. Sick leave bank for nonunion employees.
The city agrees to cooperate in the establishment of a nonunion employee sick leave bank to become effective November 2000. Members eligible and willing to participate shall contribute two days of accumulated sick leave initially. Thereafter, each member will be required to contribute one day per year until three hundred days are achieved. Members shall be eligible to participate in the bank if they have at least three years of continuous employment with the city and have at least twenty days of accumulated sick leave at the time of their contribution. (The committee, due to a serious existing illness, may waive this requirement of twenty days of accumulated sick leave.)
The bank shall be administered by a committee of three representatives appointed by the mayor. One member will be the personnel director, two others will be city employees, who will serve a two-year term. The committee shall consider the eligibility of members who will be able to draw from the bank. The decisions from the sick leave bank committee are final and binding and not subject to any grievance procedure.
The sick leave bank committee, in determining the eligibility of a member to draw from the bank and determining the amount of leave time, shall use the following criteria:
(a) A member must submit competent and timely evidence that a request is necessary to benefit the member who suffers an uncommon, life-threatening or serious lengthy illness or injury;
(b) A member's prior utilization of sick leave;
(c) Application for benefits shall be made in writing to the sick leave bank committee accompanied by a doctor's certificate as to the need for sick leave, and the anticipated recovery time from the illness. Application for benefits may be made prior to the employee's exhaustion of his or her own personal sick leave to expedite benefits, but drawings upon the bank will not actually commence until after the employee's own sick leave days are exhausted and adequate medical notification has been provided;
(d) The initial grant of sick leave by the sick leave committee to an eligible employee shall not exceed thirty days. Upon completion of the thirty day period, additional entitlement may be extended by the sick leave bank committee upon demonstration of need by the applicant. The sick bank committee may issue a grant of leave time days from the bank of not more than one hundred days per twelve month period to any one member;
(e) If an employee is granted thirty days from the sick leave bank, and subsequently returns to work prior to using all thirty days, the employee may not carry over any unused portion of those thirty days to a future illness or injury. Rather, all unused days must be returned to the sick leave bank;
(f) No days may be withdrawn from the sick leave bank for any other illness other than the prolonged illness or injury. Days may not be withdrawn to permit an individual to stay at home to care for other members of the family, and in no instance may days be withdrawn for purposes of maternity leave.

Sec. 16-19. Same Police department employees.
Effective January 1, 1969, each employee of the police department shall be credited with fifteen days sick leave, which shall be cumulative from the date of his employment and which shall not exceed one hundred sixty-five days. From this amount shall be deducted the accumulated sick leave taken by such employee for the years 1960 through 1968.

Sec. 16-20. Notice required.
Sick leave will not be allowed unless notification is given of the illness by the employee, his family or his physician within a reasonable period after the scheduled time to start work, otherwise sick leave shall not begin until after notification has been received.

Sec. 16-21. When physician's certificate required.
If the absence is more than five days or if there are repeated absences of shorter duration, a statement from the employee's physician may be required stating the form and extent of the employee's illness or disability. Subsequent certificates may be requested at the discretion of the department head.

Sec. 16-22. May be advanced with special permission.
With the special permission of the mayor, upon recommendation of the department head, sick leave may be advanced but not in excess of the total amount that would be accumulated by the end of the fiscal year.

Sec. 16-23. Refund of advance leave pay upon separation from city service.
If an employee who is indebted to the city for advance leave should separate from city service, the employee shall refund the amount paid for the period of such excess, or deduction thereof shall be made from any salary or retirement contribution due him. Departments shall keep accurate records of all sick leave.

Sec. 16-24. Not to accrue during leave of absence without pay.
Employees granted leave of absence without pay shall not accrue sick leave during such layoff or leave of absence, but upon resumption of active employment may have available the sick leave accrued before the time of such layoff or leave of absence.

Sec. 16-25. Not to be allowed for absence due to dissipation or immoral conduct.
Sick leave with pay shall not be allowed to any employee for absence caused by dissipation or immoral conduct.

Sec. 16-26. Penalties for violations or false claims of illness.
Wilful violation of any part of this division or the wilful making of false claim for sick leave shall subject the employee chargeable therewith liable to restitution and disciplinary action.

Sec. 16-27. Workmen's compensation; employees not covered under workmen's compensation.
Employees receiving compensation under the provisions of the workmen's compensation law shall be subject to the provisions of chapter 152 of the General Laws and may draw on accumulated sick leave while it lasts to make up the difference in the regular weekly pay of an employee while receiving workmen's compensation.
Employees not covered by workmen's compensation, including members of the police and fire departments, sustaining injuries or illness arising out of their employment shall be entitled to receive their net pay for the period of their incapacity. If such period exceeds thirty days, continued payment shall be subject to approval of the personnel board, which may require periodic written medical testimony supporting the claim of continued incapacity as a condition precedent to its approval.

Sec. 16-28. Accumulation of leave upon transfer of employee.
When an employee is transferred to another department, any unused sick leave accumulated to his credit shall continue to be available for his use as necessary.

Sec. 16-29. Redemption of sick leave.
One-half (fifty percent) of any earned accumulated unused sick leave shall be payable to a permanent, full-time employee upon his/her retirement, or to the spouse, beneficiary, or estate upon death of such employee. The amount payable shall not be in excess of twenty percent of annual regular salary. Such payment shall be based on one-fifth (twenty percent) of the employee's regular weekly pay for each day of accumulated sick leave. Payment of unused sick leave to employees covered by negotiated contracts, shall be in accordance with such contracts, this section notwithstanding.

Effective July 1, 2007, there is an additional amount of one percent of base for global positioning system (GPS) implementation for P-1 thru P-5.
(A) The pay scale for P-4 (police captain) shall be fifteen percent greater than the P-3 (lieutenant) pay scale.
1. Call back emergency pay of four hundred dollars per year will be added to the above weekly pay (seven dollars and sixty-seven cents per week).
2. Effective 12/1/84, police officers assigned to the radio room shall receive four dollars per shift in addition to their regular compensation.
Patrolmen who work the second shift (3:00 P.M. 11:00 P.M. or 4:00 P.M. Midnight) or the third shift (11:00 P.M. 7:00 A.M. or Midnight 8:00 A.M.) shall receive, in addition to any other compensation, a night shift differential of two dollars additional for each shift worked; such amounts of night shift differential to which an employee is entitled shall be included in the regular weekly pay of such employee.
Police lieutenants and police sergeants who work the second shift (3:00 P.M. 11:00 P.M. or 4:00 P.M. These specialists' pay may not be renegotiated for at least three years; the city reserves the right to assign nonbargaining unit personnel to these positions (excluding OIC detective bureau and safety officer); and, recognizing that present specialist personnel have years of training and experience, the specialist pay shall terminate upon the retirement of existing assigned specialists.
Call back emergency pay in recognition of the bargaining unit's (P-2 and P-3) service in an emergency call back capacity, all bargaining unit employees shall receive a call back differential effective July 1, 1984 in the amount of four hundred dollars per employee per year to be paid weekly.

The following additional pay allowances shall not be used in determining an employee's average weekly or average hourly wage for the purpose of determining overtime compensation:

Sec. 16-31. Method of step advances.
(a) All permanent full-time employees and temporary employees serving in permanent full-time positions, shall be allocated to the proper classification for their position as classified in section 16-34 of this chapter.
(b) A new employee will be employed at the minimum step rate for the classification in which he was employed.
(c) For the purpose of computing step rates, employees completing service anniversaries by July 1st of the then current year shall be eligible to advance to the next scheduled step rate.
(d) Effective July 1, 1989, officers and employees classified in the "S" classification plan will commence in the scheduled step-rate which will allow the least amount of increase from their F.Y. 1989 salary. On July 1st of each year, each employee will advance to the next scheduled step rate for their classified position.
(e) Officers and employees with positions classified in the "S" classification plan that are promoted or transferred to a different position within the "S" classification plan shall be entitled to advance to the next scheduled step for their new position on the subsequent July 1st, notwithstanding that they may have held their new position for less than twelve months.

Sec. 16-32. Promotions.
Whenever an employee receives a promotion to a position in a higher classification grade, he shall be placed at the minimum salary step rate in such higher classification. Where no increase in salary is indicated by the scheduled minimum for such new position, the promoted employee shall be advanced to the next step rate which would entitle him to the least amount of increase from his former salary step rate.

Sec. 16-33. Longevity (on regular compensation).
(a) (1) In addition to the basic annual salaries on schedule S, the following longevity schedule payments shall be added in accordance with the length of permanent full-time service performed for the city, including service in any lower grades:
After five years, one hundred thirty dollars per year;
After ten years, two hundred sixty dollars per year;
After fifteen years, seven hundred dollars per year;
After twenty years, one thousand two hundred dollars per year;
After twenty-five years, one thousand five hundred dollars per year;
Beginning with the twenty-sixth year an additional twenty-five dollars per year.

The class title of each position shall be used to designate the positions in all payrolls, budget, estimates and reports. A person shall be appointed, employed or paid as an employee in a position only if the duties of such position are actually performed. Positions shall be classified as follows:
